Terms of Service

1. Scope and Provider
These Terms of Service govern the use of NONSTOPVOD (the “Service”), operated by the provider named in the Legal Notice (Impressum). They apply between the provider and every user who registers an account. Deviating terms of the user do not apply unless the provider has agreed to them in writing.
2. Description of Service
The Service does three things for a Twitch channel the user controls:
- Archive. It stores byte-identical copies of the channel's own Twitch VODs, which Twitch itself deletes after 14 or 60 days depending on account type.
- Playback. It plays those recordings back on this site, with the ranges Twitch muted for copyright reasons filled by audio the user has chosen instead of silence.
- Replay channel. On request, it republishes the archive to a second Twitch channel the user also controls, as a continuous broadcast, so that channel is never dark.
The provider is not affiliated with Twitch Interactive, Inc. The Service depends on Twitch's own platform and interfaces; if Twitch changes or withdraws them, features may change or cease.
3. Eligibility and Account
An account may be registered only by a person with full legal capacity, or by a legal entity acting through an authorised representative. The user is responsible for the confidentiality of their access credentials and for all activity carried out through their account. Credentials and stream keys must not be passed to third parties.
4. Channels the User Must Control
The Service may only be used with Twitch channels the user controls. Before a channel's VODs are archived, and before the Service broadcasts to a replay channel, the user must prove that control by authorising the Service through Twitch's own login for the account in question. Archiving or rebroadcasting a channel belonging to somebody else is not permitted, and attempting it is a material breach of these Terms.
5. Responsibility for Content
The user remains solely responsible for the recordings archived through the Service and for the content broadcast to a replay channel. The provider does not review recordings before they are stored or streamed and adopts no recording as its own. The user warrants that they hold the rights necessary for the storage and rebroadcast described in Section 2, including in respect of music, third-party video, guests appearing on stream, and any other material contained in a recording.
Rebroadcasting on Twitch remains subject to Twitch's own Terms of Service and Community Guidelines, and to the DMCA. The provider offers a feature that substitutes replacement audio for the ranges Twitch muted, and a feature that labels a broadcast as a rerun; neither is legal advice and neither is a warranty that a given rebroadcast is permitted. Deciding what may lawfully be rebroadcast is the user's responsibility.
6. Prohibited Use
The following are not permitted:
- archiving or rebroadcasting a channel the user does not control;
- uploading or streaming content that is unlawful, infringes third-party rights, or violates Twitch's own rules;
- using the Service to circumvent a suspension, ban or other measure imposed by Twitch;
- presenting a rerun as a live broadcast where doing so is misleading, including removing a rerun label in breach of Twitch's rules;
- attempting to gain unauthorised access to the Service, other users' data, or the underlying infrastructure;
- automated use that places an unreasonable load on the Service, beyond the interfaces the Service itself provides.
7. Notice and Action
Anyone may report content stored or streamed through the Service that they consider unlawful or infringing, using the contact address in the Legal Notice. A report should identify the content and the channel concerned and explain the grounds. The provider will review reports without undue delay and, where a report is justified, take proportionate action under Section 8. The user concerned will be informed of a measure taken against their content or account and given an opportunity to respond, unless doing so would conflict with a legal obligation.
8. Measures in the Event of Violations
In the event of a violation of these Terms or of applicable law, the provider may, depending on the severity and repetition of the violation, take one or more of the following measures: issuing a warning, ending an ongoing broadcast, removing or making inaccessible individual recordings, disconnecting a channel, temporarily or permanently suspending the account, and adding the email address used in connection with the violation to a block list that prevents re-registration. The choice of measure is at the provider's reasonable discretion and must be proportionate to the severity of the violation.
9. Grant of Rights
By archiving a channel, the user grants the provider the technical usage rights required to provide the Service described in Section 2: storing the recordings, transcoding-free copying and segmenting of them, playing them back to the user and to people the user shares a playback link with, and rebroadcasting them to the replay channel the user has nominated. No further exploitation takes place. The provider does not sell, license, publish or otherwise use a user's recordings outside the operation of the Service, and acquires no ownership of them.
10. Plans, Prices and Payment
Paid plans are billed monthly in advance through our payment provider, at the prices shown on the site at the time of purchase. A plan includes a stated amount of storage; additional storage may be purchased in whole-terabyte increments at the price shown. Prices are inclusive of statutory VAT where applicable; under § 19 UStG the provider does not currently charge VAT.
A subscription runs for one month and renews automatically for further one-month periods unless cancelled before the end of the current period. Cancellation takes effect at the end of the period already paid for; fees already paid for the current period are not refunded on a pro-rata basis unless mandatory law requires otherwise. A free tier is provided with reduced limits and may be changed or withdrawn at any time.
Right of withdrawal. Consumers have a statutory right to withdraw from a contract within 14 days. Because the Service is a digital service supplied immediately, this right lapses once the provider has begun performance with the consumer's express prior consent and their acknowledgement that the right of withdrawal is thereby lost.
If a subscription lapses or a payment fails, stored recordings may be removed after a reasonable grace period and prior notice by email. Users are advised to keep their own copies of anything they cannot afford to lose.
11. Availability
The provider makes reasonable efforts to keep the Service available but gives no guarantee of continuous availability or of freedom from errors. Maintenance, technical faults, interruptions at Twitch, and interruptions of storage or network connectivity are possible. A continuous replay broadcast in particular depends on Twitch's ingest remaining available and on the user's own Twitch account remaining in good standing.
12. Liability
The provider is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence on the part of the provider, its legal representatives, or vicarious agents. For damages resulting from the breach of a material contractual obligation (cardinal obligation), the fulfilment of which is essential to the proper use of the Service in the first place and on whose observance the user may regularly rely, the provider is also liable in the case of ordinary negligence; in this case, liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded. Otherwise, liability for ordinary negligence is excluded. Liability under the German Product Liability Act remains unaffected.
13. Term and Termination
Accounts are provided for an indefinite period and are free of charge unless a paid plan has been purchased. The user may stop using the Service at any time and may request deletion of their account at any time without notice, via the contact address in the Legal Notice. Deleting an account deletes the recordings stored under it. The provider may likewise terminate an account with reasonable notice; the right to extraordinary termination for good cause, in particular a violation of these Terms, remains unaffected (see Section 8).
14. Changes to These Terms
The provider reserves the right to amend these Terms with effect for the future, for example to adapt them to changed legal requirements or to the scope of the Service. Users will be appropriately informed of material changes. Continued use of the Service after the amended terms take effect constitutes acceptance of those terms.
15. Governing Law and Final Provisions
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which a user has their habitual residence remain unaffected.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected; the invalid provision shall be replaced by the applicable statutory rule.
